Understanding What Should and Should Not Be Subtracted
Under U.S. federal guidance, short rest breaks are generally treated differently from bona fide meal periods. State and local rules may impose additional requirements.
Bona Fide Meal Breaks (Usually Unpaid): Typically lasting 30 minutes or longer, during which the employee is completely relieved from work duties. Under common workplace practice, these minutes are subtracted from elapsed shift time.
Short Rest Breaks (Usually Paid): Rest pauses of short duration (typically 5 to 20 minutes) are generally considered compensable working time under federal principles. In such cases, these are not subtracted from timesheets.
2. Mathematical Formulas for Break Subtractions
Preventing Underpayment and Overpayment Discrepancies
Formula: Net Worked Hours = (Elapsed Shift Minutes - Unpaid Break Minutes) / 60.
If a worker is present on premises from 08:00 to 16:30 (8 hours 30 minutes = 510 minutes):
• With a 30-minute unpaid lunch: 510 - 30 = 480 minutes (8.00 hours).
• With a 45-minute unpaid lunch: 510 - 45 = 465 minutes (7.75 hours).
• With a 60-minute unpaid lunch: 510 - 60 = 450 minutes (7.50 hours).
